Healing Home can receive and process your personal data in the context of the agreement with you, when you register online or place an order, when you contact Healing Home for information (by telephone, in writing or via the website) or via cookies on our website. .

 

Healing Home can also receive your data via third parties or affiliated companies.

5.      Why and on the basis of what do we process your data?

 

       Consent is free and can be withdrawn at any time.

 

5.1.     Healing Home processes your personal data for:

  • Execution of agreements / sale of products / delivery of services – customer management:

We process your personal data in order to contact you, to be able to process any questions you may have and to provide you with the necessary information about our services, promotions, discounts, our website or other information related to our activities.

We also process your personal data for managing our customer files, executing and following up online orders, payments, administration, invoicing and accounting.

We process your data in the context of the execution of the agreement with you as a customer (sales of services).

The processing of your data for these purposes is necessary for the preparation and execution of the agreement.

If you do not provide us with certain data, such as your identification data or financial data, which we need in the context of the agreement, we cannot serve you, process or execute your order(s) and/or provide you with services. .       

  • We may process your data to optimize our services. For example, Healing Home can contact you to place a review on our website. This is possible on the basis of your permission or our legitimate (commercial) interests, which if necessary outweigh your (privacy) rights or interests.

 

  • direct marketing:

       Your data can be used for direct marketing. This is the sending via our newsletter or other means of information about our services or other information that could be interesting or useful to you.

6.      Who else receives or processes your data (besides Healing Home)?

 

6.1.     Your data is primarily also processed by our partners, service providers or suppliers with whom we collaborate in the context of the sale of our services – our activities. Furthermore, our web administrators, IT partners and network administrators can also process your data in the context of your visit and use of our website. For example, companies that provide payment services, marketing services or analytical services to Healing Home can also process your data in this context.

 

6.2.     Other companies may also process your data in the context of our activities, such as our bookkeepers, accountants, auditors, insurance brokers, insurers, legal advisors or other service providers.

 

6.3.     We are not responsible for the processing of your data by third parties who do not do this on behalf of Healing Home, but who are responsible for it themselves.

7.      Are your personal data transferred outside the EU/EEA?

 

       Your data will not be passed on outside the EU/EEA.  

 

8.      How long do we keep your data?

 

8.1.     We will not keep your data for longer than necessary for the purposes such as:        described above in Article 5, unless there are special requirements with regard to the storage or processing thereof        legal provisions apply.

 

8.2.     For example, we will keep your data in the context of the delivery of our products or services] [for a maximum of 10 years after the end of the agreement (this is the limitation period for contractual claims).

 

       Different terms apply for certain other data. For example, we will keep certain social documents related to personnel for 5 years and certain accounting and tax documents for 7 years. We will keep data from applicants for up to 3 years after the application, unless we need the data to defend ourselves against a possible claim (e.g. regarding discrimination in the recruitment process), in which case we can keep the data for up to 5 years.

 

       Specific legal retention periods may also apply to other specific data. In any case, the principle applies here that we do not keep your data longer than necessary.

 

 

9.      What are your rights?      

 

9.1.     You have the right to information about the processing of your data. This will be communicated to you via this privacy policy. You can also always request us to provide additional information.

 

9.2.     You have the right to request us to:

  • access to your data.

 

For this you can get one copy of the requested information free of charge. If you request additional copies, we may charge you a reasonable fee for this as an administrative cost.

 

  • improvement of your data (if necessary);

 

  • deletion of your personal data if:

    • the processing of those data is no longer necessary for the purpose or purposes for which they were processed by us;

 

  • you have withdrawn a previously given consent;
     

  • you object to the processing by us;     
     

  • the personal data would have been unlawfully processed by us;

      

  • this is necessary to comply with a legal obligation; or    
     

  • the personal data would have been processed in connection with an offer of online services to children.

You have the right to obtain restriction of processing if you:

 

  • dispute the accuracy of the data we have;

 

  • the processing is unlawful and you object to the erasure of the personal data and request the restriction of its use instead;     

 

  • we no longer need this information, while you still need this information for the establishment, exercise or defense of legal claims; or

 

  • pending an answer to the question whether Healing Home's legitimate grounds outweigh yours or your (privacy) rights if you have objected to the processing on the basis of our legitimate interest.

9.3.     You have the right to object to the processing of your data.

 

       You can object to the processing of your data for direct marketing at any time and free of charge. This can be done easily by letting us know via  info@healinghome.be  and/or by unsubscribing from our website. This can also be done via the mailings themselves (the option to unsubscribe is always provided at the bottom). You will then no longer receive newsletters from us.

 

9.4.     You have the right to portability of your data (to another controller). This is only possible if the processing by us is based on your consent or if the processing is carried out via automated processes.

 

9.5.     If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time.

9.7.     The exercise of your rights, as set out above, is always subject to the requirements and conditions as determined in the applicable legislation (such as the General Data Protection Regulation (the so-called 'GDPR')).

 

9.8.     To exercise your rights, you can simply send a request to Healing Home at  info@healinghome.be . You must identify yourself sufficiently. When we have reasons to doubt your identity, we may ask you for additional information that is necessary to confirm your identity. We will usually ask for a copy of your identity card to verify who is actually submitting a request.

Article 1. Definitions
Healing Home is understood to mean all physical locations where yoga is offered by Healing Home.
Participant is understood to mean those who participate in the lessons, workshops, courses, events, weekends or retreats provided by Healing Home.
Lesson card, pass, turn card is understood to mean: every multi-turn card (ten turns), individual lesson or subscription (unlimited pass) that gives the customer access to the group lessons offered.

Article 2. General
2.1 Healing Home is a sole proprietorship.
2.2 Belgian law applies to all agreements concluded by Healing Home. The competent court is the court with jurisdiction for the place where the establishment is located.
2.3 The customer may attend classes with his/her lesson card, taking into account the applicable rules of that pass and the house rules.
Make sure you have a valid event card and register online via the website, or have money with you. Reserve your spot in advance. Be on time. The doors close 5 minutes before the start. Once the door is closed, you cannot enter. Turn off your phone.

house rules:
1/ Aerial cloths and mats are made available to the Customer free of charge. In case of incorrect use and/or damage, Healing Home can ask for compensation.  The mat must always be cleaned and cleaned up after use by the Customer who has used it.
2/ Shoes are prohibited in the yoga rooms. Always take off your shoes before entering the yoga room and place them in the shoe cabinet provided for this purpose in the entrance area.
3/ Come to class fresh. The use of (odorless) deodorant is highly appreciated. Classes are barefoot. So make sure your feet are washed. Due to possible allergies of other Customers, everyone is requested not to use perfume or other fragrances and not to use spray deodorant.
4/ The (physical) integrity of Customers must always be respected. Sexual behavior or sexually tinted behavior is not tolerated by Healing Home.
5/ Wear clean clothes during classes that you can move in easily. 
For hygienic reasons, you are asked to wear a t-shirt with sleeves in the aerial lessons. 
6/ Children are not allowed in the attic space without an adult.


2.4 (An employee of) Healing Home can at all times refuse or deny access to persons whose behavior gives rise to this.

Article 3 – Applicability and validity
3.1 These general terms and conditions apply to all agreements in which Healing Home acts as contractor.
3.2 Deviations from and additions to agreements concluded, or these general terms and conditions, are only valid if and insofar as they have been expressly confirmed in writing by Healing Home.
3.3 If one or more provisions in these general terms and conditions are at any time wholly or partially invalid or should be annulled, the remainder of these general terms and conditions will remain fully applicable.


Article 4 – Lesson cards, subscriptions, individual lessons
4.1 All passes are valid for 6 months from date of purchase.
You can cancel free of charge up to 22h before the start of the lesson. You can book up to 1 hour before class. 
4.2 With a 10 session card of 105 euros you can only follow the lessons before 5 pm. A 10 hour card of 130 euros gives you access to the daytime and evening classes and some weekend classes. Workshops are to be paid separately. Registration for the workshops is required. 
4.3 At the end of the period for which the lesson card applies, the remaining lessons will expire. In the meantime, lesson cards cannot be extended or discontinued, unless after submission of a medical certificate within 14 days of the date. Healing Home does not provide refunds on cards and they cannot be converted.
4.4 The class schedule can be found on the website. This schedule can be changed by Healing Home if desired, Healing Home also reserves the right to cancel classes due to force majeure. Changes in the class schedule do not entitle you to a refund of already paid class cards or an extension thereof. Changes will, as far as possible, be announced in advance via mention on the website, via the newsletter and/or by e-mail and on social media.
4.5 Registration for classes or workshops is done via the MomoYoga booking system on the website. After online registration, the customer is assured of his/her place in the relevant class or workshop, provided that the payment has been received by Healing Home.
4.6 If the maximum number of participants has been reached, the customer will be placed on a waiting list. The customer will be notified as soon as there is a free place.
4.7. When placing a reservation, the customer always receives a confirmation by email if a valid email address is provided.
4.8 Due to technological reasons, the effective delivery of confirmations and/or reminders by email can never be 100% guaranteed. Not receiving a confirmation or reminder can therefore never be invoked as a reason for terminating the agreement. If the Customer has not received a certain confirmation or reminder, he can always contact Healing Home to request it again  to send.

Article 5 – Workshops
5.1 A participant can participate in a workshop after he has registered online via the website and Healing Home has received the full amount for participation in the workshop.
5.2 If the maximum number of participants has been reached, the customer will be placed on a waiting list. The customer will be notified by e-mail as soon as there is a free place.
5.3. Healing Home reserves the right to cancel a planned workshop due to force majeure or insufficient registrations. In that case, the registration fee already paid will be fully refunded to the participant.
5.4 The applicable workshop schedule is always available on the website. Healing Home reserves the right to make organizational and substantive changes with regard to workshops and courses. Changes will, as far as possible, be announced in advance via mention on the website, via the newsletter and/or by e-mail and social media.
5.5 Cancellation of workshops and courses by the participant can only take place by e-mail and will only be discussed when the participant has reached Healing Home. Up to one week before the start date, the participant can cancel with a refund of the registration fee. If canceled later, no registration fee will be refunded.

Article 6 – Online payments and right of recall
6.1. The online payment service of Healing Home runs through the payment provider Mollie and Stripe. You pay via secure payment form with encrypted data transmission. Mollie and Stripe comply with all guidelines for the security of internet payments, drawn up by the European Banking Authority.
6.2 The participant has the right to inform Healing Home that he renounces the purchase, without payment of a fine and without stating reasons, within 14 working days from the day following the delivery of the product or the conclusion of the services agreement (ie on the day of payment).
Article 7 – Privacy
7.1. Healing Home behaves in accordance with the provisions of the law of 8 December 1992 on the protection of privacy with regard to the processing of personal data.
7.2. The person responsible for the processing of the personal data of the participants of Healing Home is Eline Vanoutrive, located at Rijksweg 354/101, Wielsbeke. 
7.3. If the participant transfers his personal data to Healing Home, these will be included in the file of Healing Home and they will be processed: for managing the customer database and the products and services offered, for carrying out market studies, to inform the customer about changes and possible new products and services, for the realization of information and promotional campaigns. The personal data will not be passed on to third parties, with the exception of Healing Hime affiliated companies that organize yoga events.

Article 8 – Opening hours
8.1 Healing Home is authorized to close its establishment in whole or in part during generally recognized public holidays and school holidays or by force majeure.
8.2 Healing Home is authorized to change the opening hours temporarily or permanently. In the event of a permanent change, Healing Home will be able to do this unilaterally as long as this is of minor importance in relation to the total number of open hours or the start or end time. The timetables for the group lessons known at the time of conclusion of the contract, as well as the opening times are always indicative. Healing Home always reserves the right to unilaterally adjust the dates and hours.
8.3 Healing Home is authorized to temporarily close the stated location or a part thereof for necessary repair or maintenance work.

Article 9 – Lecturers and timetables
9.1 Timetables are indicative and are only valid for the period stated on the website. The stated teacher can be replaced by Healing Home at any time, if necessary.

Article 10 – Liability
10.1 Healing Home excludes any liability towards its participant or any third person.
10.2 Each participant is responsible for personal accidents and his personal belongings. Each participant participates in the yoga classes offered at Healing Home at their own risk. Each participant understands that yoga requires a physical effort that may involve risk. It is the participant's responsibility to seek medical advice about suitability to participate in the yoga classes. Each participant takes full responsibility for his/her yoga practice, including possible injuries, accidents, material damage or theft that can be directly or indirectly related to participation in the classes and/or attendance at the classes.

Not a Substitute for Medical Advice

The information provided in Healing Home products, services, website, blog, conference calls, webinars, documents, audios, and videos is not intended to be a substitute for professional medical advice or treatment. Healing Home provides training, educational, coaching and learning opportunities for its clients. Clients are advised to seek the advice of a medical or mental health provider, dietician or other health care provider prior to starting or making a change in diet, exercise, lifestyle, medications or nutritional supplementation.
10.3 Neither Healing Home nor its employees can be held responsible for the loss, damage or theft of goods on the territory of the establishment.

Article 11 – Final provision
11.1 If one of the above provisions is invalid or illegal, the other provisions will continue to apply.

Healing Home assumes that the customer who is responsible for making the purchase or booking, has sufficient knowledge of Dutch to understand these general conditions. If not, these conditions can be translated upon request.
